These terms and conditions govern the use of the Flowdex Labs platform in Latvia. By using the platform, creating an account, or accessing features, you agree to these terms. If you do not agree, do not use the platform. The terms are designed to clearly define usage requirements, security obligations, limits of liability, and dispute resolution procedures.

Eligibility and Right to Use the Platform

The platform may only be used by individuals who have reached the age of 18. You certify that you provide truthful information and have the right to enter into a binding agreement. If the use of the platform is restricted in your country of residence, you are responsible for assessing compliance before use.

Account Registration and Information Accuracy

By creating an account, you undertake to provide accurate, current information and to update it promptly. If certain features require additional identity verification, you agree to submit information reasonably necessary for verification. Inaccurate or misleading information may be grounds for restricting access or suspending the account.

Security and Responsibility for Account Activities

You are responsible for the confidentiality of access data, device security, and all activities that occur with your account, even if performed by a third party using your access data. You must use a strong password, avoid reusing passwords across other services, and report any suspicious activity immediately. If additional authentication is available on the platform, enabling it is recommended as it reduces the risk of unauthorized access.

Scope of Service and Nature of Information

Flowdex Labs provides online tools, interfaces, analytics, notifications, and other features that can help navigate financial markets. Any information provided on the platform, including analytical materials, signals, calculations, or market comments, is general and informational; it is not considered financial, legal, or tax advice and is not a personal recommendation. You make decisions independently and assume responsibility for your actions.

Risk Disclosure

Trading and investing in financial markets involves significant risk. Crypto assets and derivative instruments can be highly volatile, and both partial and complete loss of invested funds is possible. Profit is not guaranteed, and past results do not predict future outcomes. Before making decisions, evaluate your experience, financial capabilities, and risk tolerance; if necessary, consider consulting an independent specialist.

Prohibited Conduct and Acceptable Use

You agree not to use the platform for fraudulent purposes, not to attempt to bypass security controls, not to gain unauthorized access to systems or other users' data, not to distribute malware, not to disrupt the platform's operation, and not to violate applicable laws. You must not use third-party payment methods without authorization or perform actions that could impose an unreasonable load on the infrastructure. If malicious activities are detected, we may restrict access, suspend the account, and, if necessary, cooperate with competent authorities.

Fees, Settlements, and Taxes

If fees apply to platform features, they will be indicated before using the respective feature or at the account level. In certain cases, third-party fees may apply, such as payment processing or partner rates; such costs may be beyond our direct control. You are responsible for tax obligations that may arise in connection with your activities.

Third-Party Services and Partner Integrations

The platform may include links, integrations, or features provided by third parties, including execution partners, brokers, verification service providers, or payment providers, where applicable. In such cases, third parties may apply their own terms and privacy conditions. We do not assume responsibility for third-party content, operational continuity, or decisions, but we strive to choose partners who meet reasonable security and quality standards.

Intellectual Property

The platform's content, software, design, trademarks, and materials belong to Flowdex Labs or its licensors. You are granted a limited, non-exclusive right to use the platform for personal purposes in accordance with these terms. You may not copy, modify, distribute, or derive parts of the platform without written permission, except where permitted by applicable law.

Access Restriction, Suspension, and Termination

We may temporarily restrict or suspend access if there are reasonable suspicions of a security incident, terms violation, fraud, unauthorized access, or if it is necessary for system maintenance. We may terminate an account if violations are material or repeated, or if legal circumstances require it. Where possible, we will inform you of significant restrictions; however, in security situations, actions may be immediate.

Disclaimers and Limitation of Liability

The platform is provided "as is" and "as available" to the extent permitted by applicable law. We strive to ensure stable operation, but we cannot guarantee that the platform will always be uninterrupted, error-free, or fully protected against external attacks. To the extent permitted by law, Flowdex Labs is not responsible for indirect damages, loss of profits, loss of data, or consequences arising from your investment or trading decisions. If liability cannot be limited, it is limited only to the minimum extent required by law.

Force Majeure

We are not liable for non-performance or delay if caused by circumstances beyond our reasonable control, including communication network disruptions, power outages, cybersecurity incidents, third-party infrastructure failure, natural disasters, or government orders.

Applicable Law and Dispute Resolution

These terms are governed by the laws of Latvia. In case of a dispute, we encourage you to first contact support to attempt to resolve it out-of-court. If an agreement cannot be reached, the dispute shall be heard in the competent court of Latvia in accordance with jurisdiction and applicable procedural norms.

Changes to Terms

We may update these terms if platform features, security requirements, or the regulatory environment change. If the changes are material, we usually announce them on the platform or via email. By continuing to use the platform after the changes come into effect, you agree to the updated terms.
